End User Licence Agreement (EULA)
1. Acceptance of Terms
This End User Licence Agreement ("Agreement") is a legal agreement between you ("you" or "the user") and The Cafe App Ltd, a company registered in the United Kingdom, governing your use of any mobile or web-based software application developed, distributed, or otherwise made available by The Cafe App Ltd (collectively referred to as the “Apps”).
By downloading, installing, accessing, or using any of the Apps, you agree to be bound by this Agreement. If you do not agree to these terms, you must not use any of the Apps.
2. Licence Grant
The Cafe App Ltd grants you a non-exclusive, non-transferable, revocable licence to download, access, and use the Apps for your personal and lawful purposes, in accordance with this Agreement.
You may not:
- Copy, modify, distribute, sell, or lease any part of the Apps;
- Reverse engineer or attempt to extract the source code of any App, except as permitted by applicable law.
3. Acceptable Use and Prohibited Conduct
You agree not to use any of the Apps in any way that:
- Breaches any applicable local, national, or international law or regulation;
- Is unlawful, fraudulent, or has any unlawful or fraudulent purpose or effect;
- Involves the transmission, distribution, or uploading of any material that:
- Is hateful, abusive, harassing, discriminatory, threatening, defamatory, obscene, or otherwise offensive;
- Incites or promotes violence, terrorism, or hatred against any individual or group, particularly on the basis of race, religion, sex, gender identity, sexual orientation, disability, or nationality;
- Infringes the intellectual property rights, privacy rights, or other rights of any third party;
- Is intended to harm or exploit minors in any way;
- Attempts to gain unauthorised access to the Apps, servers, systems, or data associated with them.
The Cafe App Ltd reserves the right to remove, restrict, or suspend any content or user account that violates this Agreement or any applicable law.
4. Termination
The Cafe App Ltd may suspend or terminate your access to any or all Apps at any time, with or without notice, if we believe you have violated this Agreement or are otherwise using the Apps inappropriately or unlawfully.
5. Disclaimer
The Apps are provided “as is” and “as available,” without warranties of any kind, either express or implied. The Cafe App Ltd does not guarantee that the Apps will be error-free, uninterrupted, or free of viruses or harmful components.
6. Limitation of Liability
To the maximum extent permitted by law, The Cafe App Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of any of the Apps.
7. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising under or in connection with this Agreement or your use of any of the Apps.
8. GDPR and Data Protection Statement
The Cafe App Ltd is committed to protecting your personal data and respecting your privacy. Any personal information collected through the Apps will be handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We only collect data necessary for the operation and improvement of our services, and we will not share your information with third parties without your explicit consent unless required by law. You have the right to access, correct, delete, or restrict processing of your personal data at any time.
